ORDER

This writ petition has been filed for a mandamus forbearing the 5th and 6th respondents herein from making new water channel through the petitioners' agricultural patta lands in Survey No.506/1, 432/1 432/2A1, 432/2A2, 432/2B1, 432/2B2, 432/2C1, 520/1, 520/2, 431/2, 431/1 and 519/2 situated at Keelaveeranam Village, Veerakeralampudur Taluk, 2/6

Tenkasi District based on the representation dated 25.11.2025.

2. Heard the learned counsel for the petitioners and learned Government Advocate for the official respondents. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

3. The learned counsel for the petitioners would submit that in the present case, the respondents 5 and 6 are taking steps to lay a water channel through the petitioners' land. The learned counsel would submit that now the petitioners are aggrieved by the action of the respondents 5 and 6 in taking steps to form a new water channel through their patta lands. However, the learned counsel would submit that when there are some other waste lands are available near the proposed formation of water channel, the respondents have not chosen the said land rather, they have opted the petitioners' land. The respondents, instead of using the petitioners' land for forming water channel, can very well lay the water channel through the waste land. In this regard, the petitioners have given a representation. However, the said representation was not disposed of 3/6

and hence, appropriate orders may be granted.

4. The learned Government Advocate would submit that the representation of the petitioners would be considered on its own merits and in accordance with law.

5. In view of the above submission, the respondents 5 and 6 are directed to consider the representation of the petitioners dated 25.11.2025. In the event, if there are any waste land available and if there are any possibility to lay the water channel through the said waste land, the respondents shall consider the same and pass appropriate final orders. The said exercise shall be completed as expeditiously as possible.

4. With the aforesaid direction, the writ petition is disposed of. No costs. Consequently connected Miscellaneous Petition is closed. 07.01.2026 NCC : Yes/No Index : Yes/No RR 4/6
