JUDGMENT

When the matter was taken up for hearing, the learned counsel for the appellant stated that connected cases in C.R.P(NPD)(MD)No.1821 of 2007 and CMA(MD)Nos.500 and 1646 of 2007 were disposed of by this Court on the ground that the policy is an Act only. In the above circumstances, there is nothing survives for adjudication in this matter and he has also made an endorsement to that effect.

2.Recording the above said submission and the endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Appeal is dismissed as infructuous. Consequently, connected miscellaneous petitions are closed. No costs.
