PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the 1st respondent from permitting the 2nd respondent herein to construct the building works without getting any approval in property in Survey No.340/34 situated at Thiruppalathurai Village, Papanasam Taluk, Thanjavur District based on the petitioner's representations dated 03.12.2025 and 22.12.2025.

ORDER
The present writ petition has been filed seeking a mandamus as against the first respondent not to permit the second respondent to put up construction without a building plan approval.
2. As could be seen from the records that a partition suit is pending between the petitioner and the second respondent herein wherein the petitioner has already sought for order of interim injunction as against the second respondent.
3. In view of the above said facts, this writ petition stands disposed of with liberty to the petitioner to approach the concerned civil Court seeking interim order of the said Court. No costs.
