Civil Miscellaneous Appeal against the order and decree of the Family Court, Madurai dated 07.04.2016 and made in HMPO No.391 of 2014.

DECREE: This Civil Miscellaneous Appeal coming on for hearing on this day and upon perusing the grounds of Appeal, the order of the Lower Court and the material papers of the Case and upon hearing the arguments of Mr.R.Narayanan, Advocate for the Appellant and of Mr.P.T.S.Narendravasan, Advocate for the Respondent and the joint memo of compromise dated 02.01.2017, this Court doth order and decree as follows:

(i)that in view of the compromise reached between the parties the Civil Miscellaneous Appeal be and hereby is dismissed. (ii)that the appellant herein agreed to receive a sum of Rs.4 lakhs (Rupees Four Lakhs only) by way of D.D.Nos.553629, 553630 dated 02.01.2017 for Rs.2 Lakhs (Rupees Two lakhs only) each vide Union Bank, Krishnankovil Branch, Watrap by the appellant as one time settlement towards maintenance for the appellant as well as the minor son namely S.R.Siddharth be and hereby is recorded. (iii)that the appellant herein agreed that she shall not take further course of action against the respondent for maintenance in future.

(iv)that the respondent herein agreed that the permanent custody and care of child S.R.Siddharth be vested with the appellant and that the Respondent shall not claim any right or custody of the child in future and shall not disturb the appellant and the child in any way.

(v)that the parties hereto be and are hereby directed to abide by the terms and conditions mentioned in the memo of compromise dated 02.01.2017.

(vi)that there be no order as to costs in this Civil Miscellaneous Appeal.
