ORDER

This Civil Revision Petition is filed to set aside the fair and decreetal order dated 22.11.2023 passed in E.A.No.1 of 2023 in E.A.No. 1 of 2021 in E.P.No.22 of 2020 in O.S.No.69 of 1998 on the file of the Sub Court, Sivagangai, Sivagangai District and allow the above Civil Revision Petition.

2. Now it is brought to the notice of this Court that a review application is filed in S.A.(MD)No.1499 of 2002 which is stated to be pending, before this Court. The petitioner has to work out remedy only in the Review Application. There is no question of adding the vendor of the petitioner as a party, at the fag end of the trial process.

3. Even though, it has been submitted by the revision petitioner that no proper finding or observation has been made by the trial Court while rejecting the petition, the fact remains that a Review Application is pending in the Second Appeal before this Court. Therefore, I find absolutely, no reason to entertain this Civil Revision Petition. 2/4

4. With this observation, this Civil Revision Petition is dismissed. No costs.
