Respondent PRAYER: Second Appeal is filed under Section 100 of Civil Procedure Code, to allow the Second Appeal setting aside the Judgment and Decree of the Learned I Additional Subordinate Judge, Tiruchirapalli dated 22.01.2008 in A.S.No.204 of 2006 reversing the Judgment and Decree of the Learned District Munsif, Musiri, dated 22.06.2006 in O.S.No.379 of 2004 and to dismiss the suit.

For Appellants : M/s.T.M.Hariharan Non appearance For Respondent : Non appearance JUDGEMENT The Learned Counsel appearing for the Appellants submitted that there is no instructions from the Appellants. It is seen that Court notice was 1/4

served to the sole respondent. Both the Appellants as well as the respondent are not inclined to further adjudicate this matter. Therefore, this Court is inclined to dismiss this Second Appeal.

2. Accordingly, this Second Appeal is dismissed for non prosecution. No Costs. Consequently, connected miscellaneous petition is also closed.
