Prayer :- Civil Revision Petition is filed under Article of the Constituttion of India, praying this Court to set aside the fair and decreetal order dated 29.02.2012 made in I.A.No.4 of 2012 in O.S.No.168 of 2010 on the file of the 1st Additional Subordinate Judge, Nagercoil.

ORDER:- Civil Revision Petition is coming on for hearing on this day and upon perusing the earlier order of this Court and the requisition letter submitted by the 1st Additional Subordinate Judge, Nagercoil vide the Letter in D.No.221 of 2020 dated 10.02.2020 and upon hearing Mr.D.Nallathambi, Advocate for the Petitioner and of Mr.R.Murugan, Advocate for the Respondent, this Court made the following order:

It is seen from the report of the Additional Sub Judge, Nagercoil that after having obtained direction from this Court for early disposal of the suit, the parties are not interested in cooperating with the Court for such early disposal. 2.It is found that petition under Order 11 Rule 4 of C.P.C., has been filed by the plaintiff and Petition under Order 8 Rule 9 https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRP(MD). No.1181 of 2012 C.P.C., has been filed by the defendants and those petitions are adjourned for enquiry for more than four occasions. 3.This shows that the parties are not willing to cooperatve with the Court for early disposal of the case at on early date. 4.In view of the same, the time cap fixed by this Court by order dated 27.09.2019 is removed.
