ORDER

The present Contempt Petition has been filed alleging violation of the orders of this Court dated 03.09.2024 made in W.P(MD) No.20906 of 2/7

2024, wherein, this Court has directed the authorities to consider the application of the writ petitioner and disburse the amount as per the Employees Provident Fund Rules within a period of two weeks.

2. The respondent Transport Corporation has filed an affidavit on 06.06.2025. Paragraph No.13 of the affidavit is extracted as follows:

13. I respectfully submit that as per present records, the Government has sanctioned assistance for employees who retired up to 30.06.2023. The petitioner, having retired on 30.11.2023, falls outside this sanctioned batch. Approximately 712 employees who retired prior to the petitioner are still awaiting settlement of their dues, which entails a financial commitment of around Rs.240 Crores (approximately). I humbly submit that due to various difficulties, challenges, experienced, by the transport corporation in order to comply the Hon'ble High Court Order the respondent undertake to settle the Balance in the provident fund loan amount in the account of petitioner from the own revenue generation from the day to day operation of vehicles. On verifying the amount as per books in Provident Fund account it was came to know 3/7

that Rs.34.14 Lakh need to be paid duly deducting the amount of Rs.4,86,000/- which was already paid. However owing to severe financial constraints in the day today activities the respondent undertake to settle an amount of Rs.5.00 lakh immediate and the balance in the provident fund amount in six installments, starts from 04.07.2025 to 04.12.2025, since the amount being huge to settle the same in single installment. The amount to be paid in the following proposal.

Payment Credit as per books of Provident Fund Account Rs.43,35,522/- 90% on his Provident Fund Account Rs.39,00,000/- Eligible Amount already paid Rs. 4,86,000/- Balance to be Paid in Seven Installments Rs.34,14,000/-

3. As per the said affidavit, the Transport Corporation has undertaken to pay the entire Provident Fund Amount in six installments, starting from 04.07.2025 to 04.12.2025.

4. Recording the said undertaking, this Contempt Petition stands closed.
