DECREE : This Civil Miscellaneous Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the order of the Lower Court and the Material papers hearing the arguments of MR.M.PRAKASH, Advocate for the Appellant and this Court while dismissing this Appeal doth order and decree as follows:- i) that the Award of the Tribunal dated 21.03.
2011 passed by the learned Motor Accident Claims Tribunal I Additional District Court Madurai made in M.C.O.P.No.1784/2006 be and is hereby confirmed and the Civil Miscellaneous Appeal is dismissed. ii) that the Appellant/Transport Corporation herein be and is hereby directed to deposit the entire award amount to the credit of M.C.O.P.No.
iii) that the Motor Claimants herein be and hereby are permitted to withdraw their shares less the amount already drawn by them without filing any permission petition before the Tribunal; iv) that the second and third respondents are minors and their share in the award amount shall be deposited in a Fixed Deposit in the Indian Bank, Madurai Bench of Madras High Court Branch, Madurai to the Credit of CMA.No.541/2016 till they attain majority ; https://hcservices.ecourts.gov.in/hcservices/
v) that the First Respondent/Mother herein who is the guardian of the respondents 2 and 3 herein be and hereby is permitted to withdraw the accrued interest, once in three months directly from the bank and utilize the same for their welfare. vi) that there be no order as to costs in this Appeal. sd/- Assistant Registrar (CS-II) / TRUE COPY / Sub-Assistant Registrar (C.S.)
