O R D E R

This Contempt Petition has been filed to punish the respondents/contemnors for not complying with the order of this Court in W.P.(MD)No.15504 of 2022 dated 18.07.2022.

2. Heard Mr.A.Rahul, learned counsel for the petitioner and Mr.S.Raja, learned Standing Counsel for the respondents.

This Court in W.P.(MD) No.15504 of 2022, vide order dated 18.07.2022, had passed the following directions:- "7.In this background, there shall be a direction to the respondents to pay the interest to the petitioner at the rate of 6% per annum on the belated payment of the retirement benefits, commencing from the date of retirement, till the date of actual disbursement, within a period of three (3) months from the date of receipt of a copy of this order. " 2/6

Today, when the matter is taken up, Mr.S.Raja, learned Standing Counsel for the respondents has produced a compliance affidavit filed by the first respondent/the Managing Director, TNSTC, Madurai, in which in paragraph No.4, it has been clearly stated that whatever the amount due to the petitioner has been paid to him. In this regard, a Chart has also been prepared. Thus, it was submitted that the respondents may be discharged from the present contempt proceedings, as the order of this Court dated 18.07.2022 passed in W.P.(MD) No.15504 of 2022 has been fully complied with by the respondents.

Mr.A.Rahul, learned counsel for the petitioner submits that he has received a copy of the compliance affidavit filed by the first respondent and also submits that the amount as disclosed in paragraph No.4 of the compliance affidavit has been received by the petitioner. Thus, he has no objection, if the respondents are discharged from the present contempt proceedings, as the order of this Court dated 18.07.2022 has been fully complied with by them and the present Contempt Petition may also be disposed of.

Accordingly, in view of the arguments advanced by the learned counsel for the parties and after perusal of the compliance affidavit filed by the first respondent and the specific averment made in paragraph No.4 of the compliance affidavit, this Court satisfied that the direction issued by this Court in W.P.(MD) No.15504 of 2022, dated 18.07.2022 has been fully complied with by the respondents and no useful purpose will be served in continuing the present contempt proceedings against the respondents.

7. Accordingly, the Contempt Petition is finally disposed of and the respondents are discharged from the present contempt proceedings. No costs. The file is consigned to record.
