Civil Miscellaneous appeal filed under Section 173 of Motor Vehicles Act, 1988, against the Award dated 21.02.2014 made in MCOP 837/2006, by the Motor Accidents Claims Tribunal, VI Additional District Court, Madurai.

DECREE:

This Civil Miscellaneous Appeal coming on for hearing on the day. Upon perusing the grounds of Appeal, the order of the Lower Court, and upon hearing this arguments of Mr.D.SIVARAMAN, Advocate for the Appellant at the admission stage , this Court doth the decree and order as follows:- i) That the Awards of Compensation passed by the Motor Accidents Claims Tribunal, VI Additional District Court, Madurai, dated 21/02/2017 made in MCOP.No.837/2006. Be and hereby confirmed in the appeal and the Civil Miscellaneous appeal is dismissed. ii)That the appellant Transport Corporation is directed to deposit the entire award amount with accrued interest and costs, within a period of Eight weeks from the date of receipt of the judgment, less the amount already deposited if any before the Tribunal.

Iii)That on such deposit is being made by the appellant Transport Corporation before the Tribunal, the Claimants are permitted to withdraw the award amount with interest and costs. iv) That there shall be no costs in the appeal herein.
