PRAYER IN CRL RC(MD)NO.281 OF 2021:
Pleased to call for the records and set aside the Judgment passed by the learned Additional District and Session Judge, Srivilliputhur, Virudhunagar District pronounced on 14/08/2019 made in Crl.A.No.167 of 2012, and confirming the Judgment pronounced on 22/10/2012 made in C.C.No. 175 of 2008 passed by the Learned Judicial Magistrate Court No.II, Srivilliputtur and acquit the petitioner from all the charges.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.G.BHAGAVATH SINGH, Advocate for the petitioner and of MR.R.SURESH KUMAR, Government Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed by this Court in Crl.M.P.(MD)No.7351 of 2021 in Crl.R.C.(MD)No.281 of 2021 dated 22.09.2021.
2.On the side of the petitioner, it is stated that this Court has granted suspension of sentence to the petitioner vide order https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.120 of 2022 dated 07.04.2021 and the petitioner is complying the condition regularly and the condition was modified on 22.09.2021, by an order of this Court in Crl.M.P.(MD)No.7351 of 2021. Subsequently, the petitioner is complying the modified condition till now and prayed the condition to be relaxed.
3.On the side of the prosecution, it is fairly admitted that the petitioner is complying the condition regularly. 4.In view of the submissions made by the learned Government Advocate (Crl. Side), this Court is inclined to relax the condition imposed by this Court in Crl.M.P.(MD)No.7351 of 2021 in Crl.R.C.(MD) No.281 of 2021 dated 22.09.2021. Hence, this Criminal Miscellaneous Petition is allowed. However, the petitioner shall appear before the respondent police as and when required and he shall appear before the concerned Court on every hearing dates.
