ORDER

Heard both sides.

2.The petitioner has made certain allegations against the third respondent. The third respondent is a Councillor of Gujiliyamparai Panchayat Union. Since action was not taken on the petitioner's complaint, the present writ petition came to be filed.

3.When the matter was taken up for hearing, the learned Special Government Pleader produced copy of the communication sent by the jurisdictional Block Development Officer to the Assistant Director (Panchayat), Dindigul. It appears that report has already been submitted to the Assistant Director (Panchayat), Dindigul. The Assistant Director (Panchayat), Dindigul shall immediately finalize the issue at his end and submit his report to the District Collector, Dindigul. This shall be done by the Assistant Director (Panchayat), Dindigul within a period of three weeks from the date of receipt of a copy of this order. Thereafter, the second respondent will decide the issue on merits and in accordance with law. A decision in this regard shall be taken by the second respondent within a period of four weeks after receipt of the report 2/4

from the Assistant Director (Panchayat), Dindigul. I make it clear that I have not gone into the merits of the matter. The defences of the third respondent are left open.
