PRAYER IN CMSA(MD) No.SR50284 of 2014:

Civil Miscellaneous Second Appeal is filed Under Section 100 of CPC R/W 10(2) of Tamil Nadu Forest Act against the order dated 17.02.2014 made in C.M.A.No.29 of 2000 on the file of the Principal District Judge, Dindigul confirming the order in Na.Ka.No.83 of 1984 dated 26.06.2000 made by the Forest settlement officer, Dindigul.

ORDER : This Civil Miscellaneous petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.LAJAPATHI ROY, Advocate for the petitioner, and this court made the following order:- This petition is to condone the delay of 1348 days in representing the second appeal. 2.The petitioner in the supporting affidavit filed for the delay would state that though appeal papers were returned for certain corrections, due to his bad health condition, he could not contact the lower court counsel to rectify the defects pointed out by the Registry. Therefore, the above days of delay occurred and prayed to condone the same.

3.Considering the age of the petitioner who is aged 70 years and the present appeal has been filed by the petitioner/appellant in the capacity as President of Sirumalai, Thenmalai Malaithotta Siru Viviasaykal Sangam and also the reasons stated in the

supporting affidavit, this Court is inclined to condone the delay on terms.

4.Accordingly, delay of 1348 days shall stand condoned subject to payment of cost of Rs.3,000/- to the Chief Justice Relief Fund on or before 11.04.2019, failing which, this petition shall stand dismissed automatically without further reference to the court.
