Common Prayer: Writ Petitions filed under Article 226 of Constitution of India, praying to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned Refusal Check Slips in RFL/Mathagupatti/21/2025, dated 12.12.2025 and RFL/Mathagupatti/22/ 2025, dated 12.12.2025 issued by the respondent and quash the same and consequently direct the respondent to register the Document dated 26.11.2025, presented by the petitioner, within the time that may be stipulated by this Court.

COMMON ORDER These Writ Petitions have been filed challenging the impugned refusal check slips issued by the respondent on 12.12.2025 and to direct the respondent to register the documents dated 26.11.2025 presented by the petitioner.

The learned counsel appearing for the petitioner would submit that the documents presented by the petitioner were refused to be registered by the respondent stating that the petitioner's name is mentioned as 'Arul Chandra Prabhakar @ A.C.Prabhakaran s/o. Arulraj @ Arunachalam', wherein in Document No.240/1992, through which, the petitioner purchased the subject properties, his name is mentioned as ' A.C.Prabhakaran s/o. Arulraj'. According to the learned counsel for the petitioner, subsequent to the purchase of the subject properties in the year 1992, due to conversion in religion, the petitioner's name was changed from 'A.C.Prabhakaran' to ' Arul Chandra Prabhakar @ A.C.Prabhakaran' and his father's name was changed from 'Arulraj' to 'Arulraj @ Arunachalam'. The Tahsildar, Sivagangai and the Revenue Inspector, Sivagangai have together issued a Certificate on 17.12.2018 stating that ' Arul Chandra Prabhakar s/o. Arunachalam' and ' A.C.Prabhakaran s/o. Arulraj' are one and the same person. Even after 2/6

production of such Certificate, the respondent refused to register the documents presented by the petitioner. He therefore, prayed for appropriate orders.

The learned Government Advocate appearing for the respondent would submit that in the documents presented by the petitioner, the petitioner's name was mentioned as ' Arul Chandra Prabhakar @ A.C.Prabhakaran s/o. Arulraj @ Arunachalam', wherein in Document No. 240/1992, his name was mentioned as 'A.C.Prabhakaran s/o. Arulraj'. Hence, the respondent was not in a position to register the documents presented by the petitioner.

4. I have given due consideration to the submissions made on either sides.

5. In the present case, initially, when the petitioner purchased the subject properties, his name was mentioned as 'A.C.Prabhakaran s/o. Arulraj' and subsequently, due to conversion in their religion, his name was changed from 'A.C.Prabhakaran' to ' Arul Chandra Prabhakar @ A.C.Prabhakaran' and his father's name was changed from 'Arulraj' to 'Arulraj @ Arunachalam'. 3/6

The Tahsildar, Sivagangai and the Revenue Inspector, Sivagangai have together issued a Certificate on 17.12.2018 stating that 'Arul Chandra Prabahar s/o. Arunachalam' and 'A.C.Prabhakaran s/o. Arulraj' are one and the same person. In view of the said Certificate, the respondent could have very well considered the registration of the documents presented by the petitioner. However, that was not done so. Hence, this Court is inclined to set aside the check slips issued by the respondent.

6. Accordingly, the impugned refusal check slips in RFL/Mathagupatti/21/2025, dated 12.12.2025 and RFL/Mathagupatti/22/ 2025, dated 12.12.2025 issued by the respondent are set aside. The petitioner is directed to re-present the documents to the respondent and on such re-presentation, the respondent is directed to register the documents presented by the petitioner, by mentioning his name as 'Arul Chandra Prabhakar @ A.C.Prabhakaran s/o. Arulraj @ Arunachalam', if they are otherwise in order, within a period of four (4) weeks from the date of receipt of a copy of this order.
