JUDGMENT

It is seen from the records that the Second Appeal was already dismissed as against Respondents 1,2 and 4 for non-payment of Batta, by order, dated 13.12.2023.

2. Wen the matter came up for hearing, the learned counsel for the appellant submits that in spite of letter sent by him, the appellant has not turned up.

3. The learned counsel for the sixth respondent submits the sole appellant died on 29.04.2015.

4. Recording the said statement, the Second Appeal is dismissed, as abated. No costs. Consequently, the connected M.P.(MD).No.1 of 2008 is closed.
