ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus, directing the second respondent to conduct an enquiry based on the complaint given by the petitioner on 19.12.2020.

2. The case of the petitioner is that one Abdul Muthalif and Alagarsamy had conspired and created various documents and managed to include the property belonging to the petitioner also and the same was illegally entertained by the third respondent and it was also registered in Document No.642 of 2020. The further case of the petitioner is that the entire transaction is fraudulent and a complaint was also given to the second respondent in this regard. It is stated that these persons have indulged themselves regularly in creating fraudulent transactions. It is further stated that the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD).No.12180 of 2021 above said Abdul Muthalif died in the year 2020. The complaint given by the petitioner before the second respondent did not evoke any response and left with no other alternative, the present Writ Petition has been filed before this Court seeking for appropriate directions.

3. Heard Mr.S.Sivakumar, learned counsel appearing for the petitioner and Mr.M.Lingadurai, learned Government Advocate appearing for the respondents 1 to 4.

Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the second respondent to consider the complaint given by the petitioner on 19.12.2020 after affording opportunity to the petitioner and the fifth respondent and deal with the same on its own merits and in accordance with law and pass final orders within a period of six (6) weeks from the date of receipt of a copy of this order.

5. The petitioner is directed to make a fresh representation to the second respondent along with all the relevant documents and also a copy of this order.

6. The Writ Petition stands disposed of accordingly. No costs.
