JUDGMENT

This appeal has been filed by the complainant as against the order of acquittal passed by the Appellate Court. 2.The issue is arising out of the complaint filed under Section 138 of Negotiable Instruments Act. It appears that neither the complainant nor the counsel are interested in prosecuting this appeal.

3.When the matter was taken up for hearing on 06.09.2019, it was represented by the learned counsel appearing for the appellant that the appellant died and he has to take steps by filing necessary application to implead the legal heirs of the appellant. Hence, the matter was posted on 20.09.2019. Thereafter, several adjournments were given. Even on 05.11.2019, there was no representation for the appellant. Hence, it was posted under the caption "for dismissal" on 08.11.2019.

4.Even today, there is no representation on behalf of the appellant/complainant. Hence, this criminal appeal is dismissed for non prosecution.
