: Respondents Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Habeas Corpus and direct the respondents 1 & 2 to produce in person or the body of the petitioner's minor grandson namely Nithees, Son of Vijayamanikandan, aged about 6 years old, the detenu herein before this Hon'ble Court and set him at liberty.

O R D E R

[Order of the Court was made by T.RAJA, J.] This Habeas Corpus Petition has been filed by the grandfather of the detenu to produce his grandson namely Nithees, Son of Vijayamanikandan, aged about 6 years, before this Court and set him at liberty.

2.In the prayer of this petition, even though it is stated this petition is filed only to produce the petitioner's minor grandson namely Nithees, Son of Vijayamanikandan, aged about 6 years, before this Court and set him at liberty, on perusal of the affidavit, filed in support of this petition, it is learnt that the petitioner herein has already lodged a complaint with the second respondent Police to secure his daughter along with her son viz., the detenu herein.

3.Today, Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor, has produced both the major detenue/daughter of the petitioner and the minor detenu/her son Nithees, Son of Vijayamanikandan, aged about 6 years before this Court. 4.After a brief conversation with the major detenue/daughter of the petitioner, it is learnt that she agreed to go with her father/petitioner herein along with the child. 5.The petitioner is also present. He has also agreed to take care of the detenus.

6.Recording the above statements, we are of the view that nothing survives for adjudication in this habeas corpus petition. 7.Accordingly, this Habeas Corpus petition is dismissed as infructuous.
