ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.C.RAMACHANDRAN, Advocate for the petitioner and of MR.B.MURUGAN, Advocate for R1 & R2, the court made the following order:- This Civil Miscellaneous Petition has been filed to condone the delay of 308 days in filing the petition for restoration of the above said appeal.

2.Heard the learned counsel on either side.

3.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed. 4.The claimants are permitted to withdraw 50% of the deposited amount, which was deposited by the petitioner to the credit of W.C.No.57 of 2008 on the file of the Deputy Commissioner of Labour (Workmen Compensation), Madurai, on their proportionate shares with accrued interest and costs by filing a proper petition before the Tribunal.
