PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the records relating to the proceedings pursuant to order made in Na.Ka.E4/5516/2020 dated 11.11.2021 on the file of the 2nd Respondent and quash the same.

ORDER

(Order of the Court was made by G.R.SWAMINATHAN, J.) The petitioner challenges the impugned order dated 11.11.2021 passed by the DRO, Sivagangai. The DRO, Sivagangai had confirmed the order passed by the RDO, Devakottai dated 03.02.2020. 2.The dispute is between the petitioner on the one hand and the 4th respondent and others on the other. The issue pertains to usage of the petition-mentioned pathway. According to the petitioner, it is a patta 2/5

land. In the impugned order itself, it has been mentioned that the issue is pending consideration before the District Munsif Court, Singampunari in O.S.No.291 of 2019. Since the Civil Court is seized of the matter, it is only just and proper that the rights of the parties abide by the outcome of the civil suit. It is stated that this suit has been transferred to the District Munsif Court,Thiruppathur and renumbered as O.S.No.112 of 2018. 3.Since the suit is 7 years old, we direct the District Munsif Court, Thiruppathur to dispose it of on merits in accordance with law within a period of six months from the date of receipt of a copy of this order. We have not gone into the merits of the matter.

4. The Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
