This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to correct the error in the FMB sketch and to issue a separate patta in the petitioner's name for the land comprised in Survey No.341/1B4B1, situated at Cumbam Pudupatti Village, Uthamapalayam Taluk, based on the petitioner's representation dated 24.11.2025, within a time frame to be stipulated by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that out of an extent of 2 Acres and 24 Cents of land in Survey No.341/B belonging to one C. Manimaran and C. Suresh as their ancestral property, the petitioner purchased an extent of 10 cents on 22.02.2021. Prior to the said purchase, the land in Survey No. 341/B had been subdivided into several parts. The petitioner purchased the land comprised in Survey No.341/1B4, which was subsequently subdivided as Survey Nos.341/1B4A, 341/1B4B1 and 341/1B4B2. Page No. 2 of 5
4. After the purchase, the petitioner's land was finally subdivided as Survey No.341/1B4B1 on 06.07.2021. However, patta has not been issued in favour of the petitioner, despite several representations having been made. On verification, the petitioner came to know that during the earlier subdivisions, errors had crept into the FMB sketch in respect of the lands. Due to such variations in the FMB sketch, there is an error on the southern side of the petitioner's land, which is shown as 2.6 metres instead of 6.6 metres. Therefore, the petitioner submitted a representation dated 24.11.2025. Since the same has not been considered, the petitioner was constrained to file the present Writ Petition.
5. The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation dated 24.11.2025 would be considered and appropriate orders would be passed by the second respondent within a period of eight weeks.
6. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's Page No. 3 of 5
representation dated 24.11.2025 on its merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. The representation dated 24.11.2025 shall be considered and disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner and any other interested parties who may be affected by the decision. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. There shall be no order as to costs.
