JUDGMENT
When the matter came up for hearing today, the learned counsel appearing for the appellant filed a memo stating that the sole appellant died and though several communications have been sent to the son of the sole appellant by name Mr.V.Gopal seeking necessary details with regard to legal representatives, till date he has not received any instructions from the son of the appellant and hence, he reports "no instructions".
2. The suit is of the year 2004. This second appeal has been filed against the concurrent judgment passed by the Courts below in the year 2007. In view of non filing of batta for notice, this second appeal has already been dismissed in respect of the 3rd respondent on 30.06.2008. The appellant has not paid II-batta for issuing notice to the 2nd respondent. SECOND APPEAL No.59 of 2007 sole appellant ie., son of the appellant, he has not given any instructions, it appears that son of the appellant is not interested in prosecuting the matter further. However, as the sole appellant died, this Court is inclined to dismiss this second appeal as abated. Accordingly, this second appeal is dismissed as abated. No costs.
