For Respondent : Mr.S.MANIKANDAN, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 821 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under section 379, 430 I.P.C. r/w. Section 21(1) of Mines and Minerals (Regulation and Development) Act, 1957, in Crime NO.821 of 2021, on the file of the respondent police, seek anticipatory bail.

2.The case against the petitioners is sand theft. A case in Crime NO.821 of 2021 has been registered against them. 3.On the side of the petitioner, it is stated that the allegation against the petitioner is transporting 1⁄4 unit of river sand each using bullock carts. The petitioners are innocents and they have been falsely implicated in this case and the name of the petitioners was not found in the F.I.R and the petitioners have no bad antecedents and prayed the petition to be allowed. 4.On the side of the respondent, it is stated that totally 4 accused were involved in this case. CRL OP(MD). No.86 of 2022 A2 to A4. A1 was arrested and he is still in custody and prayed the petition to be dismissed.

5.It is seen that the co-accused is arrested and he is still in custody. In view of the above circumstances, this Court is not inclined to grant anticipatory bail to the petitioners. Hence, this Criminal Original Petition is dismissed.
