PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to extend the time granted by this Court dated 08.11.2023 in CRP(MD).No. 2234/2018 for payment of cost.

ORDER

This Court by order, dated 08.11.2023, has allowed C.R.P.(MD)No.2234 of 2018, on condition that the revision petitioner to pay a cost of Rs.2,000/- to the respondent within a period of two weeks.

2.According to the learned Counsel appearing for the revision petitioner, due to some communication gap, the said order could not be complied with in time. Now a Demand Draft for Rs.2,000/- has been sent to the respondent and the postal receipt has also been enclosed along with a xerox copy of the Demand Draft. The petitioner has sought for extension of time for payment of the above said amount.

3.The learned Counsel appearing for the respondent has filed counter strongly objecting to the extension of time to be granted to the petitioner for payment of the cost.

4.Considering the fact the cost has already been paid to the respondent herein, though belatedly, this Court is inclined to allow the present petition. 5.The trial Court is directed to treat I.A.No.81 of 2016, as allowed and proceed in accordance with law.

6.With the above said observations, this Civil Miscellaneous Petition stands disposed of.
