ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the official respondents.

2. The only request made by the petitioner is that the second respondent must dispose of the petition mentioned proceedings pending on his file. Even though in the writ prayer it has been prayed that the second respondent must pass an order considering the report of the third respondent, I would only clarify that the third respondent's report will be taken into account. The issuance of direction by this Court should not be construed that the third respondent's report is binding on the second respondent. The second respondent is directed to dispose of the petition mentioned proceedings on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order. It is open to the second respondent to pass order one way or the other. I make it clear that I have not gone into the merits of the matter.

3. This writ petition is disposed of accordingly. There shall be no order as to costs.
