JUDGMENT

************ [Order of the Court was made by K.RAVICHANDRABAABU, J.] This Civil Miscellaneous Appeal is filed against the Judgment and degree made in H.M.O.P.No.09 of 2014, dated 06.02.2016. 2.After entertaining this appeal, this Court, by order dated 29.01.2019, referred the matter to the Mediation and Concilliation Centre of this Court. Consequently, the Mediation took place and an agreement between the parties was arrived at on 12.03.2019. The Mediation and Concilliation Centre through its report, dated 12.03.2019, reported that the Mediation completed by enclosing the agreement entered between the parties, the terms of which, read as follows:- "1.Disputes and differences had arisen between the Parties hereto and CMA(MD)No.756/2016 was filed on 01.08.2016 before Hon'ble High Court.

2.The matter was referred to mediation / concilliation vide an order dated 29.01.2019 passed by THE HON'BLE MR.JUSTICE S.S.SUNDAR AND THE HON'BLE MR.JUSTICE C.SARAVANAN.

3.The parties agreed that Mr.N.Tamilmani & Mr.T.Jeen Joseph would act as their Mediator.

4.Several meetings were held and during the process of Mediation / Concilliation from 12.02.2019 to 12.03.2019 and all the parties have with the assistance of the Mediator voluntarily arrived at an amicable solution resolving the above mentioned disputes and differences.

5.The parties hereto confirm and declare that they have voluntarily and of their own free will arrived at this Settlement Agreement in the presence of the Mediators. 6.The following settlement has been arrived at between the Parties hereto:

1.Both parties are not willing to lead their matrimonial life.

2.Both of them wanted to nullify their marriage and given consent for divorce.

3.Both parties agreed that there will no claims against each other in future in this regard.

7.By signing this Agreement all the Parties hereto state that they have no further claims or demands against each other with respect to CMA(MD)No.756/2016 and all disputes and differences in this regard have been amicably settled by the Parties hereto through the process of concilliation / Mediation."

3.The learned counsel on either side submitted that the Civil Miscellaneous Appeal may be disposed of in terms of the agreement arrived at between the parties before the Mediation Centre. 4.Accordingly, this Civil Miscellaneous Appeal is disposed of by recording the above agreement arrived between the parties before the Mediation Centre. No costs. Consequently, connected Miscellaneous Petition is closed.
