PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the Respondents 1 to 3 renew the Petitioner's Husband Mr.Velraj Masanam's Passport bearing Passport No. M9657108 by considering the Petitioner's husband's passport renewal 1/4

ORDER

The present writ petition has been filed seeking a mandamus as against the respondents 1 to 3 to renew the passport of the writ petitioner based upon the application made by the petitioner's wife on 29.10.2025.

2. The petitioner's passport has expired on 01.06.2025 and he is in Dubai as on today. The petitioner has been implicated in a criminal case which has culminated in filing of a charge sheet in C.C.No.96 of 2022, on the file of Learned District Munsif Cum Judicial Magistrate, Boothapandy. As on today, NBW is pending as against him.

3. In view of the above said facts, the petitioner has approached this Court seeking a direction for renewal of the passport with retrospective effect. 2/4

4. Considering the above said facts, the petitioner is directed to approach the second respondent to get emergency certificate to land in India. On landing in India, he is directed to surrender himself before the concerned trial Court and get the NBW recalled. Thereafter, apply before the said Court seeking permission of the Court to go abroad. Based upon the orders to be passed by the trial Court concerned, the third respondent is directed to proceed in accordance with law.

5. With the above said observations, this writ petition stands disposed of. No costs.
