PRAYER : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first and second respondents i.e., the Chief Engineer (Agricultural Engineering Department), Chennai and the Superintending Engineer (Agricultural Engineering Department), Thanjavur to pass appropriate orders on the petitioner's appeal dated 30.08.2021 preferred against the impugned orders passed by the Executive Engineer (AED), Thanjavur in proceedings No.A/328/2019 dated 27.09.2020, within a specified time frame that may be fixed by this Court. ORDER
The relief sought for in the present writ petition is to dispose of the appeal preferred by the petitioner before the first respondent within a reasonable period of time.
2. Mr. S.Visvalingam, learned counsel appearing for the petitioner submits that the petitioner, who is working as an Inspector of Hand Boring Set Grade-I in the office of the Assistant Executive Engineer (AED), was not given promotion, due to the punishment imposed as against him by the Executive Engineer (AED), Thanjavur. The petitioner has preferred an appeal as against the order of punishment before the first respondent on 30.08.2021. However, the Appellate Authority has not passed any orders in the appeal and his opportunity of promotion is affected. Hence, the https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.[MD].No.187 of 2022 petitioner has filed this writ petition to dispose of the appeal.
3. Mr.J.Ashok, learned Additional Government Pleader takes notice for the respondents.
4. In view of the limited relief as sought for by the petitioner in the writ petition, this Court, without expressing any opinion on the merits of the matter, directs the first respondent to dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order.
