ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent herein to dispose the petitioner's appeal filed in E-4105977, dated 22.12.2025, within the time limit as fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 5 to 7, notice to the respondents 5 to 7 is hereby dispensed with.

The learned counsel for the petitioner submits that the petitioner's grandfather and grandmother purchased certain portions of the subject land from the son and daughter of one Adaikan Sampan under various registered sale deeds, and the purchases were made on different dates and under different document numbers. Simultaneously, one Pandian, the forefather of the respondents 5 to 7, also purchased certain lands in the same survey number. After completion of the purchases by both sides, the total extent purchased tallied with the original extent recorded in the Adangal Register. As per the Patta Register, most of the lands continue to stand in the name of Adaikan Sampan even till date; however, only one extent in Survey No.3/28E was transferred in the name of Balasubramaniam, son of Pandian, on the alleged ground that the said land was purchased by Pandian from a third party, who in fact had no title or possession over the said land. As a result, the petitioner's lawful extent has been improperly reduced.

The learned counsel for the petitioner further submits that the core issue involved is the inclusion of the petitioner's name in the patta register in respect of Survey No.3/28E, Block No.30, Usilampatti Town, Madurai District. However, the second respondent erroneously passed an order stating that the petitioner's

counsel had orally waived the petitioner's claim, which is factually incorrect. In reality, the counsel had only left the issue open with respect to Survey Nos.3/26 and 3/27 (earlier Survey No.120/6A5). The petitioner's ancestors purchased the properties strictly in accordance with law, the transactions were duly registered before the Sub-Registrar, and the petitioner and his predecessors have been in continuous enjoyment and possession of the property till date. Even assuming that Survey Nos.3/26 and 3/27 had any bearing on the petitioner's claim, the second respondent ought to have issued notice to the present owners of those lands before passing any adverse order, which was not done. The order passed by the second respondent is contrary to the factual records and suffers from nonapplication of mind. Aggrieved thereby, the petitioner preferred an appeal before the first respondent, which was numbered as E-4105977 of 2025, but the same has not been considered or disposed of till date.

6. The learned Special Government Pleader appearing for the respondents 1 to 4 submits that the petitioner's appeal dated 22.12.2025 will be considered and disposed of on merits and in accordance with law within a time frame to be fixed by this Court.

Recording the aforesaid submission and without going into the merits of the matter, this Court directs the first respondent to consider the petitioner's appeal dated 22.12.2025 and dispose of the same on merits and in accordance with law, after affording due opportunity to all the parties concerned, within a period of twelve weeks from the date of receipt of a copy of this order.
