When the matter was taken up for hearing on 30.01.2026, this Court, after conclusion of arguments, observed that the Second Appeal would be dismissed.

However, upon perusal of the records and documents, this Court found that certain aspects of the case, particularly the validity of the acknowledgment in Ex.A.2, had not been addressed during the course of arguments. Hence, the matter was listed today for clarification.

2. The learned counsel appearing for the respondent submitted that the case papers had been returned to the client and, therefore, he was unable to advance his submissions. He requested that the matter be listed in the second week of March 2026 to enable him to place his arguments before this Court.

3. Considering the request made, the earlier order of this Court stands recalled.

The Registry is directed to list the matter on 16.03.2026 for fresh hearing.
