(1) That the award passed by the the judgment and decree of the Motor Accident Claims Tribunal cum 2nd Additional Sub Court, Madurai dated 01.09.2005 made in M.C.O.P.No.949 of 2004, are hereby set aside and the case is remitted back to the Tribunal.
(2) That the Trial Court do restore the petition in its original number and proceed to dispose of the petition in accordance with law and in the light of the observation and directions contained in the Judgment herein.

(3) That the third respondent is to be impleaded in the petition.
(4) That both the parties are at liberty to file statements, to examine further witnesses and to mark further documents.
