PRAYER IN CRL A(MD) No.437 of 2021:

To call for the records and set aside the judgment and conviction dated 01.10.2021 made in Spl.Case.No.223 of 2019 on the file of the learned Sessions Judge,(Special Court for POCSO Act Cases), Tirunelveli, and acquit the Appellant/Sole Accused. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.DEENADHAYALAN, Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate(Criminal Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed by this Court in Crl.M.P.(MD)No.8682 of 2021 in Crl.A.(MD)No.437 of 2021 dated 09.11.2021.

2.On the side of the petitioner, it is stated that this Court has granted suspension of sentence to the petitioner vide order dated 09.11.2021 and the petitioner is complying the condition till now and prayed the condition to be relaxed.

CRL MP(MD) No.107 of 2022 3.On the side of the prosecution, it is fairly admitted that the petitioner is complying the condition regularly. 4.In view of the submissions made by the learned Government Advocate (Crl. Side), this Court is inclined to relax the condition imposed by this Court in Crl.M.P.(MD)No.8682 of 2021 in Crl.R.C.(MD) No.437 of 2021 dated 09.11.2021. Hence, this Criminal Miscellaneous Petition is allowed. However, the petitioner shall appear before the respondent police as and when required and he shall appear before the concerned Court on every hearing dates.
