ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.S.SENTHILSANKARANATHAKUMAR, Advocate for the petitioner and of MR.C.JAWAHAR RAVINDRAN, Advocate on behalf of the 1st respondent, the court made the following order:- This Civil Miscellaneous Petition has been filed to withdraw the entire award amount deposited in C.M.A.(MD) No.946 of 2018 in M.C.O.P.No.1564 of 2015 on the file of the Motor Accidents Claims Tribunal/Special Sub Court, Tirunelveli.
2.Heard the learned counsel for the petitioner. 3.Considering the submission of the learned counsel for the petitioner, this Court is inclined to permit the petitioner to withdraw the admitted liability of Rs.20,16,000/-. It is represented by the learned counsel for the petitioner that the amount is now pending in the deposit of Indian Bank, Madurai Bench of Madras High Court, Madurai. Madurai Bench of Madras High Court, Madurai, is directed to transfer the amount of Rs.20,16,000/-, which was deposited by the Special Sub Court, Tirunelveli, to the credit of M.C.O.P.No.1564 of 2015 on the file of the Motor Accident Claims Tribunal cum Special Subordinate Judge, Tirunelveli within a period of one week from the date of receipt of a copy of this order.
