The learned counsel on either side submitted that the main suit itself was dismissed on merits by judgment and decree dated 12.10.2017. It was also brought to the notice of this Court an appeal has been filed against the judgment and decree passed by the trial Court.

2.In view of the above development, nothing survives in this Civil Revision Petition and the Civil Revision Petition is closed. It is left open to the petitioner to raise all the issues in the appeal that has been filed against the judgment and decree of the trial Court. No costs. Consequently connected Miscellaneous Petition is closed.
