For Petitioner Mr.D.Venkatachalam For Respondents Mr.S.Shaji Bino Special Government Pleader C O M M O N O R D E R The issue that arises for consideration in this batch of writ petitions is one and the same and as such, they are taken up for consideration together and being disposed of by this common order.

All the petitioners herein participated in the recruitment process undertaken by the Tamil Nadu Public Service Commission vide Notification No.135 of 2007 dated 15.11.2007 and got selected in terms of the selection list published on 07.11.2008 / 08.11.2008. Thereafter, the process of certificate verification was also concluded in the month of December, 2008 and the provisionally selected candidates were allotted to various Departments, including, Medical Department, Education Department, Rural Development Department, Revenue Department etc. All the petitioners herein are the candidates, who got appointed as Typist / Steno Typist Grade-III and all of them, though were selected prior to 01.06.2009, were appointed in their
respective Departments only after 01.06.2009. In the meanwhile, the Government issued a Government Order in G.O.Ms.No.234, Finance (Pay Cell) Department, dated 01.06.2009, implementing the recommendations of the Sixth Pay Commission with effect from 01.01.2006. Subsequently, another Government Order was issued in G.O.Ms.No.258, Finance (Pay Cell) Department, dated 23.06.2009, amending some of the provisions of the Government Order in G.O.Ms.No.234, Finance (Pay Cell) Department, dated 01.06.2009. It was thereafter due to certain anomalies, a One Man Commission came to be appointed by the Government for removing the anomalies and accordingly, based on the report submitted by the One Man Commission, the Government issued a Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.
2010, directing that the Junior Assistants from among the Contract Assistants / Agricultural Officers and any other similar categories of posts recruited by the Tamil Nadu Public Service Commission in the same batch prior to 01.06.2009 and joined / appointed on a subsequent date on or after 01.06.2009 due to administrative reasons duly allowing the fitment benefit to the individual employees concerned as a special case with monetary benefit from 01.08.2010.
"4) The Government has carefully examined the above recommendations of the One Man Commission and decided to rectify the anomaly as pointed out by the One Man Commission. Accordingly, Government direct that in exercise of the powers conferred under Rule-13 of the Tamil Nadu Revised Scales of Pay Rules, 2009 relax the Rule-9 of the Tamil Nadu Revised Scales of Pay Rules, 2009 in favour of the incumbents recruited as Junior Assistants from among the Contract Assistants / Agricultural Officers and any other similar categories of posts recruited by the Tamil Nadu Public Service Commission in the same batch prior to 1-6-2009 and joined / appointed on a subsequent date on or after 1-6-2009 due to administrative reasons duly allowing the fitment benefit to the individual employees concerned as a special case. However, Government direct that the above fixation benefit shall be given notional effect from the date of appointment of the individual employees concerned with monetary benefit from 1-8-2010. "
3. The petitioners herein, who were also got selected prior to 01.06.2009 and got appointed only after 01.06.2009, started making a claim
for the benefit of the said Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010, contending that they are also similarly situated like the Junior Assistants, Contract Assistants / Agricultural Officers etc., who are benefited under Paragraph No.4 of the said Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010. But, the case of some of the petitioners herein was considered and rejected by the concerned authorities by passing appropriate orders and in respect of some of the petitioners herein, their case has not been considered at all in spite of repeated requests made by the respective petitioners. While so, the Public Health and Family Welfare Department issued a proceedings bearing No. 4738/AB1/2019-2, dated 03.06.
2019, not to extend the benefit of the said Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010, to other similarly situated persons and therefore, the said proceedings came to be challenged in some of the writ petitions herein. As the case of some of the petitioners herein has not been considered at all, they have approached this Court by seeking a writ of mandamus directing the respondents to extend the benefit of the said Government Order in G.O.Ms.No. 340, Finance (Pay Cell) Department, dated 26.08.2010, to them.
4. Heard the learned counsels for the respective petitioners and learned Additional Government Pleader appearing for the respondents.

Learned counsel for the petitioners contended that the very same issue as to the application of the Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010, to other similarly categories of employees, who were selected prior to 01.06.2009, but appointed after 01.06.2009, has fallen for consideration before this Court on repeated occasions, wherein it was held that the benefit of the said Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010, is available to all other similarly situated categories of employees and therefore, all the petitioners are also liable to be declared as entitled to the benefit of the Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010, by duly quashing the impugned proceedings.
Learned counsel for the petitioners placed reliance on a common order passed by a Coordinate Bench of this Court in W.P.(MD) No.13775 to 13779 of 2022, dated 13.10.2022. She also further submitted that the said order of the learned Single Judge was affirmed by the learned Division Bench of this Court in W.A. (MD) No.520 of 2023 and batch, by a common Judgment dated 01.12.2023.
dismissed by the Honourable Apex Court vide order dated 19.02.2024 in S.L.P.(C) Nos.2451 - 2455 of 2024. Thus, it is the categorical contention of the learned counsel for the petitioners that the petitioners herein are entitled to the similar benefit as was extended to the petitioners in the above said order dated 13.10.2022 passed by the learned Single Judge of this Court in W.P.(MD) Nos.13775 to 13779 of 2022.

On the other hand, Mr.S.Shaji Bino, learned Special Government Pleader appearing for the respondents contended that mere selection by the Tamil Nadu Public Service Commission will not confer any right to any of the candidates, but it is only on appointment to the respective posts the same would amount to recruitment. In the instant case, according to the learned Additional Government Pleader appearing for the respondents, all the petitioners herein were recruited only after 01.06.2009 and there was no recruitment prior to 01.06.2009. Therefore, they are not entitled for the benefit of the Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010. In support of his contentions, he also placed reliance on a decision of the Honourable Apex Court in the case of Prafulla Kumar Swain vs. Prakash Chandra Misra, reported in 1993 Supp (3) SCC 181.
7. This Court has carefully considered the submissions made on either side and also perused the entire materials on record.
8. The decision relied upon by the learned Additional Government Pleader appearing for the respondents, in the considered view of this Court is, in noway, helpful to the case of the respondents. In the said decision, the word "recruitment" was construed as "enlistment", "acceptance", "selection" or "approval for appointment" and the same does not amount to "appointment" or "posting in service". In contradistinction, the word "appointment" means an actual act of posting a person to a particular office. In the instant case, as seen from the language used in Paragraph No.4 of the Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010, the issue with regard to the pay anomaly of the incumbents recruited as Junior Assistants by the Tamil Nadu Public Service Commission prior to 01.06.
2009 and appointed / joined subsequent to 01.06.2009, has fallen for consideration and they were extended the benefit of fitment under the said Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010. Thus, in a way, the decision relied upon by the learned Additional Government Pleader appearing for the respondents aids the case of the petitioners herein.

Be that as it may, as rightly contended by the learned counsel for the petitioners, the very same issue has fallen for consideration before this Court in W.P.(MD) No.13775 to 13779 of 2022, wherein the Coordinate Bench of this Court, by a common order dated 13.10.2022, has held as follows: "9. The learned counsel appearing for the petitioner drew my attention to the catena of decisions passed in this regard. One such decision is dated 22.10.2021 made in W.P.(MD)No.17859 of 2014. Paragraph Nos.9 & 10 of the said order reads as follows:- 9.It is true that the Government Order vide G.O.(Ms)No.340, Finance Department, dated 26.08.2010, was passed on the recommendation of One Man Commission to remove the pay anomaly in the case of Junior Assistants/Agricultural Officers, who were selected prior to 01.06.2009 and appointed on or after 01.06.
2009. It is not in dispute in the present case that the petitioners also were selected prior to 01.06.2009 but appointed after 01.06.2009 due to administrative reasons.
lawful. It is the duty of Government to remove pay anomaly, if they have reasons to believe that the disparity was due to some administrative delay.
10.The decision of Government in the case of Junior Assistants/Agricultural Officers is a formal expression of the policy of the Government in matters relating to re~fixation of salary on par with persons selected by the same process but appointed after a particular date due to administrative delay. Unless, there is a strong reason to treat a particular category of cases differently the decision vide G.O.Ms.No.340, Finance Department, dated 26.08.2010, cannot be ignored and the Government cannot reject the case of others in other departments ignoring the decision already taken in respect of a class of people. In this case, the Government Order vide G.O.Ms.No.340, Finance Department, dated 26.08.2010, was on the basis of recommendation of One Man Commission to remove pay anomaly. When it is the duty of the Government to remove pay anomaly in exercise of its sovereign function, this Court is unable to find any justification in not applying the decision of Government vide G.O.Ms.No.
340, Finance Department, dated 26.08.2010 in the case of petitioners. While extending the benefit of G.O.Ms.No.340, Finance Department, dated 26.08.2010, to several other persons, this Court in W.P.(MD)Nos. 15375 to 15383 of 2013, by its order, dated 03.10.2019, observed that the benefit of G.O.Ms.No.340, Finance Department, dated 26.08.2010, should be extended to similarly placed persons.
10. It is true that a different note has been struck in the order dated 05.07.2022 in W.P.No.10546 of 2014 (Secondary Grade Seniority Teachers Association Rep. by its State General Secretary Vs. Secretary to Government). But the said writ petition was filed by an Association and there is nothing on record to show that the factual matrix that is obtaining in the said writ petition is similar or same as the one in the present batch of writ petitions.
11. The only issue that calls for consideration is this. Whether the writ petitioners were recruited / selected prior to 01.06.2009 by TNPSC. If the answer is in the affirmative, the petitioners have to be given the benefit of G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010. Even the respondents
cannot dispute that the writ petitioners were selected prior to 01.06.2009. To be precise, all the writ petitioners were selected in November 2008. Therefore, I have no hesitation to follow the aforesaid decision relied on by the learned counsel appearing for the petitioners. That apart, Paragraph No.6 of G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010, makes the position fully clear. It is as follows:-
(6) The above orders allowing fitment benefit is not applicable to the new recruits in whose cases the selection list have been issued by the Tamil Nadu Public Service Commission / Employment Exchange and consequent appointment orders issued by the Heads of Department after 01.06.2009 ie., after the date of issue of notification of the Tamil Nadu Revised Scales of Pay Rules, 2009, in the G.O first read above. In such cases, the new recruits are entitled to have their pay fixed only at the minimum of the Pay Band plus grade pay applicable to the respective posts.
12. It can be seen therefrom that the Government wanted to deny the benefit of G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010 only to those who were recruited and appointed after the cutoff date
ie., 01.06.2009. Admittedly, the petitioners do not fall within the scope of Paragraph No.6. Therefore, the orders impugned in the writ petitions are set aside. The writ petitions are allowed. No costs."

The above said order dated 13.10.2022 was subjected to an appeal in W.A.(MD) No.520 of 2023 and batch and the learned Division Bench of this Court, by a common Judgment dated 01.12.2023, confirmed the order of the learned Single Judge and held as follows: "6. From a reading of the said Government Order in its entirety, it is manifest that the fitment order under G.O.(Ms)No.340, dated 26.08.2010, was not restricted to the Junior Assistants/Agricultural Officers. It would be applicable to those who were recruited earlier, but the posting/appointment orders were issued after 01.06.2009. The Government in exercise of the powers conferred under Rule 13 of the Tamil Nadu Revised Scales of Pay Rules, 2009, relaxed Rule 9 of the Tamil Nadu Revised Scales of Pay Rules, 2009, in favour of the incumbents recruited as Junior Assistants from among the Contract Assistants / Agricultural Officers and any other similar categories of posts recruited by the Tamil Nadu Public Service Commission in the same batch prior to 01.06.2009 and joined/appointed on a subsequent
date on or after 01.06.2009 due to administrative reasons.
7. It is not disputed that the recruitment process of the respondents was undertaken in the year 2008. The select list was also published on 07.11.2008. The certificate verification was also conducted on 05.12.2008. Only due to administrative reasons, the appointment orders were issued to these respondents on 03.08.2009. It would appear that the respondents are not at fault. The respondents are similarly situated as that of the Junior Assistants/Agricultural Officers covered under G.O.(Ms)No.340, dated 26.08.2010. There was no reason to apply different yardstick to these respondents. A Division Bench of this Court in W.A.No.186 of 2023, dated 02.02.2023 [The State of Tamil Nadu and others vs. C.Jayapradha and others], was dealing with the case of Assistant Agricultural Officers. The Assistant Agricultural Officers were also not named in G.O.(Ms)No.340, dated 26.08.2010. The benefit was accorded to the Assistant Agricultural Officers recruited prior to 01.06.2009, however, appointment orders were issued after 01.06.2009."
11. The Special Leave Petitions filed there-against the said Judgment passed by the learned Division Bench of this Court was admittedly dismissed by the Honourable Apex Court vide order dated 19.02.2024 in S.L.P.(C) Nos.2451 - 2455 of 2024.

In the instant case, there is no dispute on the factual aspect of the matter as to the selection / recruitment of the petitioners herein by the Tamil Nadu Public Service Commission prior to 01.06.2009 and their appointment getting delayed due to administrative reasons and the fact that they were appointed after 01.06.2009. Therefore, in the considered view of this Court, there is no need to delve deep into the matter as the issue has already been considered by this Court on number of occasions. Therefore, the impugned proceedings in the respective writ petitions are liable to be quashed.
13. Accordingly, the impugned proceedings in the respective writ petitions are quashed. Consequently, all the writ petitions are allowed directing the respective respondents to extend the benefit of the Government Order in G.O.Ms.No.340, Finance (Pay Cell) Department, dated 26.08.2010, to the petitioners herein and re-fix their pay as expeditiously as possible, at any
rate, within a period of four months from the date of receipt of a copy of this order and release all the consequential benefits to them within a further period of two months. No costs. Consequently, connected miscellaneous petitions are closed.
