To Direction Directing the respondents 1 And 2 to accord police protection to the petitioner to carry on the coumpund wall construction in the Property in S.NO. 1816, R.S . No. 146/10B, Ezhudesom Village, Vilanvancode Taluk, Kanyakumari District admeasuring 14.65 cents based on the complaint dated 14.06.2019. ORDER

This Contempt petition has been filed to punish the respondent for the wilful disobedience of the order of this Honourable Court in Crl.O.P(MD) No.12977 of 2019 dated 18.09.2019.

2. Today, when the matter is taken up for hearing the learned Additional Public Prosecutor would submit that in this case this Court had directed to conduct enquiry on the complaint lodged by the petitioner and the counter party namely the fourth respondent/Kolappan and pass orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of the order. He would submit that enquiry was conducted and during enquiry the said Kolappan also produced patta in respect of the very same property and thereby the respondent police has referred https://hcservices.ecourts.gov.in/hcservices/ 1/2

Cont.P(MD)No.29 of 2020 the matter to the Revenue Divisional Officer for conducting enquiry and waiting for report from the Revenue Divisional Officer. He would also submit that the fourth respondent has produced documents stating that he has filed Civil Revision Petition against the order passed by the District Munsif, Kuzhithurai in O.S.No.547 of 2010.

3. Contemnor present before this Court.

4. This Court is of the opinion that no contempt has been committed on the side of the respondent. Hence, this Contempt petition is closed.
