For Respondent : Mr.K.K.Ramakrishnan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.40/2019 on the file of the Respondent Police.
ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offence punishable under section 420 of I.P.C., in Crime No.40 of 2019 on the file of the respondent police, seeks anticipatory bail.
3. The learned Additional Public Prosecutor would point out that though there are a number of victims and the amount involved is fairly large, as far as the petitioner is concerned, a sum of Rs.2,80,000/- was handed over to her.
4.The petitioner's counsel states that the petitioner would deposit the said amount of Rs.2,80,000/- to the credit of Crime No.40 of 2019 before the jurisdictional Magistrate within a period of three months.

Since the petitioner is willing to make the good amount in question and since the petitioner happens to be a lady, I am of the view that her arrest is not going to serve any purpose. 6.Granting the time sought for and subject to this condition, anticipatory bail is granted. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate, Valliyoor, Tirunelveli District, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
