PRAYER IN CRP(MD) No.SR33804 of 2017:

to set aside the order of dismissal on default passed in I.A.No.139 of 2016 in I.A.No.94 of 2011 in O.S.No.17/2010 dated 07.06.2016 on the file of II nd Additional Subordinate Judge, Madurai.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Additional Government Pleader, for the petitioner, the court made the following order:- Heard both sides.

2. There is an inordinate delay of 340 days filing the revision and therefore, this Court feels that the delay can be condoned on https://hcservices.ecourts.gov.in/hcservices/ payment of costs to the Legal Aid. Accordingly, the delay is condoned and this petition is ordered on condition that the

petitioner shall pay a sum of Rs.1500/-(Rupees one thousand and five hundred only) to the Legal Aid Service Authority, attached to this Bench, within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall automatically be dismissed without furthr reference to this Court. sd/- 07/12/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.)
