ORDER: The Court made the following order:- The petitioner/A-1 was arrested and remanded to judicial custody on 21.07.2023 for the offences punishable under Sections 302 @ 302, 120(b), 147, 148, 149 of IPC on the file of the respondent police and charge sheeted in S.C. No.163 of 2023 on the file of Principal Sessions Court, Dindigul, seeks bail. 1/4
2. The case of the prosecution is that the deceased and the petitioner had some previous enmity. Also, on 26.06.2023 a leaked video was spread in social media which shows the petitioner and one boy were involved in a sexual relationship. The petitioner claimed that the deceased was the reason for the release of the video and he had motive against the deceased. Due to that on 19.07.2023 the petitioner and other accused persons conspired together and attacked the deceased with deadly weapons and thereby the deceased was done to death.
3. The case of the petitioner is that the petitioner is an innocent person and he did not commit any offences as alleged by the prosecution. Due to the pending cases as against the petitioner, he had been falsely roped in this case without any basis. The investigation is completed and charge sheet is also filed and the S.C.No.163 of 2023 on the file of Principal Sessions Court, Dindigul, is pending. All other accused were released on bail. The petitioner is in judicial custody from 21.07.2023 onwards. Hence in the present case the petitioner is seeking bail.

It is seen from the records that the present petition is 5th bail application, totally there are 9 accused, charge sheet has been filed, Trial has started, most of the witness had turned hostile, now the case is posted on 10.02.2026. The petitioner is having 44 previous cases, including 3 brutal 2/4
murder cases. There is an organized crime syndicate which is running under the head of the petitioner. In the present case, the petitioner is A1 and there is specific overt against the petitioner.
5.Considering the criminal background and the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Hence the criminal original petition is dismissed.
