Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the Respondents 1 to 4 to remove the encroachment from Survey No.346/4, 322/8 to 11, 13 Mudukulathur Village and Taluk, Ramanathapuram District in Saravana Poigai Oorani and clean the Saravana Poigai remove encroachment in and around the Pillaiyar Temple situated on the bund situated Saravana Poigai and shops in the bund portion. ORDER

Heard the learned counsel appearing for the writ petitioner, the learned Additional Government Pleader appearing for the respondents 1 to 3 and the learned Standing Counsel appearing for the fourth respondent. 2.The petitioner seeks removal of encroachments in the petition mentioned survey numbers. Copy of the A-register has been enclosed. It is seen therefrom that Survey Nos.322/8 to 11 and 13 are not water bodies. Therefore, no relief can be granted in respect of those survey numbers. 2/5

3.The learned Additional Government Pleader concedes that Survey No.346/4 is a water body.

4.We make it clear that the scope of the writ petition is confined only to Survey No.346/4 alone. We direct the second respondent to conduct survey after issuing notices to all the encroachers / interested parties. Survey exercise shall be done within a period of two months from the date of receipt of a copy of this order. If encroachments are noticed, the fourth respondent shall remove the encroachments as per the provisions of the Tamil Nadu Urban Local Bodies Act. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order. 5.This Writ Petition is disposed of accordingly. No costs.
