PRAYER:

This Petition filed under Article 227 of the Constitution of India to set aside the docket order dated 04.09.2012 made in I.A.No.70 of 2012 in R.C.O.P.No.14 of 2010 on the file of the Principal District Munsif cum Judicial Magistrate (Rent Control Court), Karaikudi.

O R D E R

This Civil Revision Petition has been filed against the order passed by the Court below scrapping a portion of the report filed by the Advocate Commissioner and directing him to revisit the property and find out the existence of the old stair case. For this limited purpose, the warrant was re-issued to the Advocate Commissioner.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.

3. This Court does not find any illegality or infirmity in the order passed by the Court below and the Court below has reissued the warrant to the Advocate Commissioner for a very limited purpose and it is made clear in the order itself that the Advocate Commissioner shall not make any other observations in the report. This case is arising out of rent control proceedings, which has been pending from the year 2010 onwards and therefore, a direction will have to be issued for the disposal of the petition. In the result, the Civil Revision Petition is dismissed and the Court below is https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRP.(MD).No.1982 of 2012(PD) directed to complete the proceedings in R.C.O.P.No.14 of 2010, within a period of six weeks from the date of receipt of copy of this order. No costs. Consequently, the connected miscellaneous petition is closed.
