ORDER : The Court made the following order :- The petitioner / Accused No.1, who apprehends arrest at the hands of the respondent Police for the offences under Sections 498(A), 323, 494 and 109 IPC in 1/4

Crime No.35 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner (Accused No.1) developed a relationship with the defacto complainant through social media and there was a love affair. The petitioner had physical relationship with the defacto complainant and he also married the defacto complainant in a temple in the presence of witnesses. Thereafter, the petitioner left the defacto complainant and he also married another girl, as a result of which, the defacto complainant attempted to commit suicide. There are totally eight accused persons and the petitioner has been arrayed as Accused No.1.

3. The learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that the investigation has been completed and the police report has been filed before the learned Judicial Magistrate No.V, Madurai and it has been taken on file in C.C.No.2368 of 2024. He further submitted that the petitioner has been shown as an absconding accused.

4. The learned counsel appearing for the petitioner submitted that anticipatory bail has been granted to all other accused persons in Crl.O.P.(MD).No.16370 of 2024, dated 27.09.2024.

5. Taking into consideration the facts and circumstances of the case and considering the fact that the investigation has been completed and the case is now 2/4

pending before the learned Judicial Magistrate No.V, Madurai, there shall be a direction to the petitioner to surrender before the learned Judicial Magistrate No.V, Madurai, within a period of two weeks from the date of receipt of a copy of this order. On such surrender, the learned Judicial Magistrate shall get a bond executed by the petitioner with two sureties under Section 91 of BNSS and necessary conditions can be imposed.
