THE HONOURABLE MR.JUSTICE R.PONGIAPPAN S.A (MD) No.533 of 2008 Ganesan ... Appellant/Respondent/Defendant Vs.
Velayutham ... Respondent/Appellant/Plaintiff PRAYER: Second Appeal is filed under Section 100 of the Code of Civil Procedure, 1908, against the judgment and decree of the learned Principal District Judge, Pudukottai, dated 17.08.2006 rendered in A.S.No.31 of 2001 reversing the judgment and decree of learned Principal District Munsif, Pudukottai dated 21.11.2000 rendered in O.S.No.92 of 1999.
For Appellant : No appearance For Respondent : Mr.G.Sridharan
JUDGMENT
Today, when the appeal is taken up for hearing, there was no representation on the side of the appellant. In fact, as per the entries made in the order sheet dated 07.08.2019, the learned counsel appearing for the appellant reported no instructions from the appellant. Further, on 30.07.2019, the very same learned counsel appearing on behalf of the appellant intimated to this Court as the sole appellant has passed away two years back. So nothing survives in keeping this appeal further more.
2. Hence, for the reasons stated above, this Second Appeal is dismissed as abated. No costs.
