ORDER

The writ petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to make correction in the FMB sketch in connection with Survey Nos.143/5A2, 143/5B2 and 143/7, to an extent of 35 cents, situated at Muppaiyur Post, Devakottai Taluk, Sivagangai District, by considering the petitioner's representation dated 11.11.2024 within the time frame fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the petitioner is the owner and in lawful possession of land measuring 35 cents comprised in Survey Nos.143/5A2, 143/5B2 and 143/7 situated at Muppaiyur Post, Devakottai Taluk, Sivagangai District. Due to an error in the FMB sketch relating to the above survey numbers, the petitioner is facing serious difficulty in enjoying and dealing with the property. Therefore, the petitioner submitted a representation dated 11.11.2024 to the respondents seeking correction of the said error in the FMB sketch. Despite the lapse of considerable time, the respondents have failed to consider the said representation and take appropriate action. Hence, the present Writ Petition.

4. The learned Additional Government Pleader appearing for the respondents submits that the respondents 3 and 6 require 12 weeks' time to complete the enquiry and pass orders in accordance with law after affording sufficient opportunity to all the stakeholders.

Recording the aforesaid submission and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents 3 and 6 to conclude the enquiry on the representation of the petitioner dated 11.11.2024 and pass appropriate orders on merits and in accordance with law, after providing reasonable opportunity during such enquiry to the petitioner and also any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.)
