O R D E R
This Writ Petition has been filed to call for the records relating to the impugned order passed by the 2nd respondent in Na.Ka.No.
1313/A4/2022, dated 27.09.2022, to quash the same and consequently to direct the 2nd respondent to cancel the sale deeds vide Doc. Nos.11031 of 2010, dated 16.12.2010, 1044 of 2011 dated 04.12.2011 and 1770 of 2011 dated 25.02.2011 registered in the office of the 3rd respondent.
2. In the impugned order, the 2nd respondent has stated that there is a title dispute between the rival parties and therefore, the petitioner is directed to approach the trial Court. However, all the parties had already approached the Civil Court in O.S.No.121 of 2012 along with I.A.No.591 of 2017 and I.A.No.378 of 2012, wherein the parties contested the matter 2/5
and a final judgment was rendered in I.A.No.591 of 2017 on 05.03.2020. The title has been declared in favour of the petitioner and it is stated that the respondents 4 and 5 herein have not preferred any appeal. Now, the writ petitioner restricts his prayer only to registration of the Judgment and Decree alone.

Considering the limited prayer, this Court is inclined to grant the same and the 3rd respondent is directed to register the Judgment and Decree passed in I.A.No.591 of 2017 in I.A.No.378 of 2012 in O.S.No.121 of 2012 dated 05.03.2020. Further, if any party is aggrieved, they are at liberty to prefer an appeal and the same shall be considered in accordance with law.
4. With the above observations, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed. 08.08.2025 trp Index : Yes / No Internet : Yes 3/5
