J U D G M E N T
The learned counsel for the appellant submitted that he took notice on the respondent but the same had returned unserved with an endorsement "no such person available at the address" Hence, the appeal stands dismissed for non prosecution. However, liberty is granted to the appellant to have the appeal restored, after the appellant finds the correct and current whereabouts of the accused. With this liberty to have the appeal restored, this appeal is dismissed for non prosecution.
