Aggrieved by the order dated 09.01.2012 made in E.P.No.153 of 2011 in O.S.No.93/1985 on the file of the Principal District Munsif Court, Tirunelveli, the petitioner, who is the defendant, is before this Court.

2. When this petition is taken up for hearing, the learned counsel for the respondent submitted that even though the respondent has got the benefit of the order in her favour, the petitioner/defendant has filed the second appeal before this Court in S.A.No.739/1994 and this Court allowed the same on 04.07.2016 and there is nothing to be adjudicated and in view of the judgment rendered in the second appeal, the present Civil Revision Petition has got to be allowed.

3. Recording the said submission made by the learned counsel for the respondent, the Civil Revision Petition is allowed. No costs. Consequently connected Miscellaneous Petition is closed.
