PRAYER: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus directing the fourth respondent to forward the petitioner's CPS proposal to the first to third respondents to get the retirement benefits along with incentive increment for the M.Phil Degree consequently restraining the first to fourth respondent from collecting the incentive increment obtained by the petitioner for the M.Phil Degree within the time limit stipulated by this Court.

When the matter is taken up for hearing, the learned Counsel appearing for the petitioner submits that as per the instructions of his client, he intends to withdraw the present writ petition and sought permission of this Court to withdraw this petition and also he made an endorsement to that effect.

2.Recording the same, this writ petition is dismissed as withdrawn. At request of the learned Counsel for the petitioner, liberty is granted to the petitioner to challenge the proceedings in Na.Ka.No.60 of 2024, dated 29.08.2024, issued by the fifth respondent, if so advised. There shall be no order as to costs.
