ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present Writ Petition seeking a direction to forbear the respondents from opening a new TASMAC wine shop within the jurisdiction of the petitioner's village, namely Karaiyur Village, Ponnamaravathi Taluk, Pudukkottai District, based on his representation dated 02.12.2025.
2.The grievance of the petitioner is that he is a resident of Karaiyur Village, where more than 3000 families reside, and the locality is predominantly agricultural. It is contended that certain individuals engaged in anti-social activities have initiated steps to open a TASMAC shop in the village, for which a Boomi Pooja was conducted on 24.10.2025. The petitioner further submits that about 15 years ago, the villagers had successfully protested for the closure of a TASMAC shop, pursuant to which a Panchayat Resolution was passed prohibiting such establishments, and since then, the village has remained peaceful. 3/8
3.The petitioner further states that the proposed shop is situated in close proximity to a Government School, Temple, and Mosque, and is located on a main road used by students and villagers to access schools and hospitals. It is apprehended that the establishment of the TASMAC shop would adversely affect school children, women, and elderly persons, and may also pose safety risks, particularly as students commute late in the evening. Despite submitting a representation dated 02.12.2025 to the authorities seeking to prevent the establishment of the TASMAC shop, no action has been taken. Hence, the present Writ Petition has been filed seeking appropriate relief.
4.The learned Standing Counsel appearing for the respondents 2 to 4 submitted that the proposal is pending consideration before the District Collector, Pudukkottai District, and that no permission has been granted so far.
5.Heard the learned counsel appearing on either side and perused 4/8
the materials available on record.
6.On perusal of the materials available on record, it is seen that, in respect of the very same village and for the same relief, one Bharathidasan had earlier filed a writ petition in W.P(MD)No.31671 of 2025 and this Court, by order dated 27.11.2025, directed the District Collector, Pudukkottai District, to consider the objections raised by the villagers. 7.In view of the above, the representation of the petitioner dated 02.12.2025 shall also be taken into consideration by the District Collector, Pudukkottai District, who shall consider the same, along with the objections of the villagers, keeping in mind the larger public interest, and pass appropriate orders on merits and in accordance with law, as expeditiously as possible.

8.With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. consequently, connected Miscellaneous Petition is closed.
